Art. 1 Subject and Scope

These Terms of Service (hereinafter "Terms") govern access to and use of the Manifst platform (hereinafter "the Service"), published by Adrien Savelli, sole proprietor, with registered head office at 6 Allée des Restanques, 13016 Marseille, France (SIREN: 797 513 470).

By accessing or using the Service, you agree to be bound by these Terms. If you do not accept these terms, you must not access or use the Service.

Art. 2 Service Access

The Service is accessible via any modern web browser with an active Internet connection. Manifst reserves the right to deny access to the Service, without prior notice or compensation, to any user who fails to comply with these Terms.

Access Requirements

  • Be a legal adult or a duly constituted legal entity;
  • Provide a valid email address;
  • Accept these Terms and the Privacy Policy.

Art. 3 User Account

Registration to the Service is free and requires creating a personal account. Users commit to providing accurate, complete, and up-to-date information upon registration.

Users are solely responsible for maintaining the confidentiality of their login credentials. Any activity conducted through a user account is deemed performed by the user. In case of unauthorized access, users must notify Manifst immediately at contact@manifst.net.

Art. 4 Description of Service

Manifst is an agile project management platform providing:

  • 3-level hierarchical backlog management (Super Epics, Epics, Tickets);
  • Sprint planning, tracking, and velocity monitoring;
  • Interactive Kanban boards;
  • Collaborative real-time Planning Poker sessions;
  • Time tracking and Earned Value Management (EVM) budgeting;
  • Team governance with roles and permissions;
  • Sprint reviews and retrospectives.

Manifst reserves the right to modify, enhance, or suspend any feature of the Service at any time.

Art. 5 User Obligations

Users agree to use the Service in compliance with applicable laws and these Terms. Specifically, users shall not:

  • Use the Service for unlawful, illegal, or fraudulent purposes;
  • Publish unlawful, defamatory, obscene, or infringing content;
  • Attempt to access unauthorized user data or accounts;
  • Intentionally disrupt or overload the Service infrastructure;
  • Resell or sublicense access to the Service without prior written consent.

Art. 6 Intellectual Property

All software, brand assets, logos, user interfaces, code, text, and visual designs constituting the Service are the exclusive property of Adrien Savelli (Manifst) and are protected by international intellectual property laws.

Content created by users while using the Service (projects, backlog items, tickets, uploaded files) remains the property of the user. Users grant Manifst a non-exclusive, worldwide, royalty-free license to host and display user content solely to operate the Service.

Art. 7 Personal Data

Personal data processing is governed by the Manifst Privacy Policy, fully compliant with the General Data Protection Regulation (GDPR).

Art. 8 Service Availability

Manifst strives to maintain 24/7 Service availability. However, service interruptions may occur due to planned maintenance, updates, or events of force majeure. Manifst cannot be held liable for any impact resulting from temporary service unavailability.

Art. 9 Limitation of Liability

Manifst provides the Service under an obligation of means. Manifst shall not be liable for indirect damages, loss of business, data loss, or loss of revenue arising from the use or inability to use the Service.

Manifst's total aggregate liability shall be strictly limited to the amount paid by the user for the Service during the 12 months preceding the claim.

Art. 10 Termination

Users may close their account at any time via account settings. Manifst reserves the right to suspend or terminate access for any user in breach of these Terms, without prior notice or refund.

Upon account closure, user data is retained for 30 days before permanent deletion, unless statutory retention periods apply.

Art. 11 Modifications to Terms

Manifst reserves the right to update these Terms at any time. Users will be notified of material changes via email or in-app notification. Continued use of the Service after notification constitutes acceptance of the revised Terms.

Art. 12 Governing Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, parties agree to attempt amicable settlement prior to initiating court actions. Failing amicable resolution, disputes shall be submitted to the competent courts of Paris, France.
